General Terms and Conditions of Rental future hub

Scope

These General Terms and Conditions govern the business relationship between Bridge and the client/lessee (hereinafter referred to as the Partner). The validity of any deviating general terms and conditions of the Partner is excluded.

Conclusion of contract, contractual partners, liability

The acceptance of the order is made orally, by telephone or in writing (equivalent to electronic confirmation by e-mail) and is only valid with the written confirmation by Bridge. Unless any discrepancies are reported within 5 working days, these order confirmations are considered binding. If the Partner is not the contractual partner itself, but the order is placed for a third party as the contractual partner, the Partner shall be jointly and severally liable with the contractual partner for all obligations arising from the contract.

Quotation

Quotations are provided free of charge, unless otherwise agreed. Quotations are valid for 30 days.

Prices/Rates

The rates are determined by the offer or by the contract between Bridge and the partner. The rental prices listed on the website www.bridgezurich.ch serve as a basis. If agreed in writing, the prices may differ.

Additional services/aids

  1. Reserved rooms are only available to the partner within the period agreed in writing.
  2. If the agreed start and end times of the event change without the prior written consent of Bridge, Bridge is entitled to charge additional costs for the deployment of personnel and the use of the premises and equipment, unless Bridge is responsible for the changed times.
  3. If event participants do not settle their personal costs, the partner is jointly and severally liable with the event participants.
  4. The use of the partner’s own electronic equipment on Bridge’s power supply requires Bridge’s consent. Any faults or damage to Bridge’s technical equipment caused by the use of this equipment shall be at the partner’s expense.

Terms of payment

Invoices will be issued at the latest by the end of the month following the event. Invoices are to be paid within 30 days.

Services, prices, payment

  1. The contractual partner is obliged to pay the prices agreed for these services. This also applies to services and expenses of Bridge to third parties in connection with the event.
  2. If no other agreement is made, drinks will be invoiced according to actual consumption. Used bottles are considered to be completely consumed.
  3. The agreed prices include the respective statutory value added tax. If there is a change in the rate of VAT after the contract has been concluded, the rate of VAT in force at the time the service is provided shall apply.
  4. Bridge is entitled to demand a reasonable advance payment at any time.

Amendments

  1. Any amendments or additions to this contract must be made in writing and signed by both parties in order to be valid.
  2. For events at which food and drink are served, the actual number of participants may not be more than 10% below the number stated in the event contract, regardless of when the reduction occurs.
  3. The partner is obliged to inform Bridge of the final number of participants no later than five working days before the start of the event.
  4. If the number of participants increases, the invoice will be based on the actual number of participants.

Cancellation

Cancellations must be made in writing. In the event of cancellation, the following costs will be charged per booking:

  • up to 1 month before the event: no costs
  • up to 10 days before the event: 50%
  • up to 5 days before the event: 75%
  • 5 days before the event: 100%.

Withdrawal by Bridge / Right of Reprimand

If the advance payment is not made even after a reasonable grace period set by Bridge has expired, Bridge is entitled to withdraw from the contract.

Furthermore, Bridge is entitled to withdraw from the contract for objectively justified reasons, for example if:

  1. force majeure or other circumstances for which Bridge is not responsible make it impossible to fulfill the contract.
  2. events are booked under misleading or false statements of material facts, e.g. the partner or the purpose.
  3. Bridge has reasonable grounds to believe that the event may jeopardize the smooth business operations, security or public reputation of Bridge.
  4. The partner allows third parties to use the rented rooms without the consent of Bridge.
  5. Disruptions to normal operations or damage to the infrastructure are to be expected or have already occurred.
  6. The house rules of Bridge or the instructions of the house service have been disregarded.
  7. The planned events are in competition with the offers of Bridge.

If Bridge exercises its right of withdrawal or right of expulsion, the partner has no claim for damages against Bridge.

In the event of illness on the part of Bridge (event chef, event host), the event will inevitably be canceled without compensation.

Use of the premises

  1. Four scenarios for seating / room settings (see appendix) are standard and must be announced at least one week before the rental.
  2. When the kitchen is rented, two cooking stations are included. The set-up of an additional two cooking stations is charged at a flat rate of CHF 100.
  3. The table arrangement may be changed, but must be restored to its original state at the end of the event.
  4. The partner is obliged to handle food in a responsible and resource-efficient manner.
  5. The kitchen infrastructure may only be used by the partner if this has been recorded in writing, instructions for the equipment have been provided by Bridge and the corresponding fee is owed.
  6. If the kitchen is rented, it is expected that the food will be purchased at Bridge.
  7. If you wish to bring your own alcoholic beverages, we will charge you CHF 30 per wine bottle, CHF 2.50 per bottle for beer with alcohol, and CHF 150 for a bottle of spirits.

Liability of the partner for damages

  1. The partner has to return the rooms, the infrastructure and the furniture in the same condition as they were taken over (including washing the dishes and wine glasses).
  2. The room must be swept clean. If the cleaning is insufficient or not done at all, a bill of CHF 200 will be sent.
  3. The Partner shall be liable for all damage to buildings or inventory caused by the Partner itself, event participants or visitors, or its employees and agents.
  4. If, at Bridge’s sole discretion, extraordinary soiling necessitates special cleaning or additional waste collections, Bridge shall take the appropriate precautions and charge the Partner for the additional costs incurred.
  5. The Partner is responsible for ensuring that the number of persons admitted does not exceed the capacity of the room in question. The maximum numbers stated by Bridge are binding in this regard. The Partner is responsible for ensuring compliance with safety regulations (no blocking of emergency exits, compliance with the smoking ban, etc.). Bridge declines all liability in the event of non-compliance.
  6. Any defects, damage or faults of any kind must be reported to the caretaker immediately.
  7. Repairs are the sole responsibility of Bridge.
  8. Any wilful damage to the building, furniture or fixtures will result in liability for damages.

Items brought by the Partner

  1. The Partner warrants that any decoration or other material brought in complies with the fire safety requirements. Due to the possibility of damage, the installation and attachment of objects must be agreed with Bridge in advance.
  2. Packaging materials, exhibits or other items brought in must be removed without residue at the end of the event. If the Partner fails to do so, Bridge may remove and store them at the Partner’s expense.
  3. Smoke machines, open fires and highly flammable materials are not allowed. In the event of non-compliance, any costs incurred by the emergency services will be charged to the Partner.

Services of the lessor

  1. Bridge provides the services described in the offer on the agreed dates. Insofar as advance services (e.g. advance payments) of the partner are agreed for the provision of services or the cooperation of the partner is agreed or necessary, Bridge is only obliged to provide services to the extent that the partner fulfills his obligations to cooperate or provide advance services.
  2. Bridge may make additional services dependent on a corresponding written order from the partner. Services not included in the offer are to be paid for additionally by the partner in any case.
  3. Instructions from the Partner to Bridge in the course of executing the order are only binding if they are given in writing or confirmed in writing by Bridge. Bridge is not obliged to follow instructions that significantly delay or complicate the provision of services or cause significant additional work.
  4. Bridge is obliged to proceed with due care in the execution of the order. When selecting food and beverages, importance is placed on impeccable quality.

Services

The following services are included in the rental fee: Wi-Fi, heating, power supply and basic lighting.

Other services are available upon request. Prices are listed in the rate schedule (Appendix).

Miscellaneous

  1. The partner may use Bridge’s name and trademarks to promote its event with Bridge’s consent.
  2. The house rules are an integral part of these General Terms and Conditions.

Final provisions

Amendments or supplements to the contract or these GTC shall only be effective if made in writing. Unilateral amendments or supplements by the partner shall be invalid.

Compliance with the provisions

The partner is responsible for ensuring that the applicable provisions are complied with by all participants at the event and that the instructions of the building services department are followed.
